FLOYNEX DIGITAL TECHNOLOGIES LTD makes no warranties, express or implied, regarding the continuous availability, operational uptime, or absolute error-free nature of the system.

2. M-Pesa Integration and Third-Party API Gateway Disclaimer

Floynex Pay integrates directly with Safaricom M-Pesa via live Daraja APIs to handle deposits (STK Push / Paybill 123456) and outbound withdrawals (Business B2C transactions).

**Floynex explicitly disclaims any liability for financial losses, missed opportunities, or operational delays caused by Safaricom infrastructure failures.** This includes, but is not limited to: delayed STK Push prompts, network timeout callbacks, delayed Paybill transaction statements, or stuck B2C payouts. Floynex acts solely as a processing facilitator and cannot dictate third-party mobile network stability.

3. User Input, QR Code Scanning, and Copy-Paste Errors

Our platform features automated data-entry conveniences, including dynamically generated account QR codes for scanning, dashboard copy buttons, and account link sharing functionality.

**Floynex assumes zero liability for funds sent to the wrong destination due to user error.** If you scan a blurry QR code, execute a transfer using an incorrect copied/shared account string, or misinterpret automated typed text fields, the transaction is processed purely on your command. Floynex is under no legal obligation to reverse or trace funds misrouted by user input mistakes.

4. Personal vs. Business Profile Toggling and Tax Disclaimer

The platform provides a settings toggle enabling users to switch between a Personal Profile and a Business Profile.

• **Display Names:** Switching to a Business Profile alters transaction visibility to read your chosen trade name, while a Personal Profile reads your government-issued identity names.
• **Tax & Regulatory Accountability:** Floynex is not an investment, legal, or tax advisor. If you conduct commercial activities via a Business Profile, you are independently and solely responsible for reporting and settling all relevant digital levies, VAT, and business income taxes directly with the **Kenya Revenue Authority (KRA)**. Floynex disclaims any liability arising from your failure to declare commercial revenues accurately.

5. In-App Admin Inbox Communications

While Floynex uses the internal system Inbox to transmit vital alerts, technical maintenance warnings, emergency updates, and account policy compliance notifications, the delivery of these messages is subject to internet connectivity. Floynex is not responsible for any operational oversights, account suspensions, or financial discrepancies resulting from your failure to log into the platform, check your inbox, or act upon warning notifications sent by the administration panel.

6. No Financial or Investment Advice

The presence of a digital wallet or ledger system on Floynex Pay does not constitute a banking deposit account, asset custody service, or investment instrument. Holding digital balances within the Floynex ledger framework yields zero interest. You understand that your wallet balance should be used exclusively to execute legitimate transaction processing, and Floynex does not act as a fiduciary or licensed financial broker.

7. Limitation of Damages

To the maximum extent permitted under the Laws of Kenya, FLOYNEX DIGITAL TECHNOLOGIES LTD, its founders, and directors shall not be held liable for any direct, indirect, consequential, special, or exemplary damages—including but not limited to loss of profits, commercial reputation, user data, or personal funds—arising out of ledger latency, system maintenance, unauthorized access to your device, or any disruption to our processing services.
